I expect him to select a judge with left leanings, but at least choose a judge who understands the basics of a high school civics class. What is the function of the Judicial Branch of government?

Judge Sonia Sotomayor: Court is Where Policy is Made

I saw that yesterday on CNN. Seems like it was just a bit of misspeak, but wtf, she's a freakin judge, she shouldn't be misspeaking at all.

I'm a little concerned about the case with the firemen thats pending in the Supreme Court. If that gets overturned I think that will damage her a bit, but with 60 dem votes in the Senate it doesn't really matter.

I don't like her because of her decisions she made in a case involving Major League Baseball.

Her credentials are among the most sterling of all the Supreme Court judges and the most "kind of establishment" credentials (courts at several levels). I don't understand why anyone would consider her unqualified, or why they would consider her an unwise choice.

She issued the injunction in 1995 ordering them back to work and sided with the players in her opinion.

She did that? For some reason I thought it was a male judge that ordered them back.

Fuck her then. That decision was as much horseshit as Reagan firing all the airline workers.

Now that I'm home, let me add more.

There are some that thought she did the right thing, and some said she really put a burden on the players by what she did. But I don't.

All I heard of at the time was Cal Ripken's streak coming to an end. I REALLY want to say that was actually brought up in the court, but I don't remember for sure.

Did you not watch the link? She didn't flippantly make that remark. She believes that she should make law and NOT interpret the constitutionality of a law. That's scary as Hell!

She also said in a presentation at Berkeley that a latina necessarily interprets the law differently than a white male.

They do.....by taking a fine point marks-a-lot to her eyebrows and putting on lip liner while interpreting the law. Something a white man wouldn't do....unless his name is Cledus. ;)

Reagan fired Air Traffic Controllers, not airline workers. They were fired for an ILLEGAL strike. They quickly learned that you didn't fuck with Ron.... just like those commie bastards....

whatever. how can you have an illegal strike? that's the strongest stance a union can take. what good is a union if they can't strike?

If the govt is going to take that much interest in something they shouldn't let it get that far.

She is just another Mexican that I have to listen to running her cake (or flan) hole. I get enough of that shit at home. I will bet that she thinks that she is right about everything too.

I wonder if she can make some kick ass huevos rancheros....

Very easily when Congress passes a law that makes it illegal for unionized government employees to strike.

I know, but when you take away a union's ability to strike then you have effectively dissolved that union. That doesn't sound legal either.

The law was passed in the 50's and it was upheld by the SC in reference to the ATC strike. That makes it legal. Going on strike is far from the only tool that unions have in getting what they want. The primary purpose of a union is for collective bargaining, not the threat of strikes. Taking away the ability to strike doesn't mean the union has no purpose.

Striking is not the only weapon unions have in their arsenal, but it's their most powerful one. You gotta admit they're pretty neutered without that option.

And that ruling from the Court surprises me. Must've been a bunch of Nixon/Ford appointees at the time.
